In consideration for granting me a membership by Sandy Hook Speedway, LLC (hereafter referred to as the SHS, LLC); and in consideration of the promotion and operation of race events by the SHS, LLC; and consideration of the granting of permission to enter, use, and remain on the track facilities and/or premises at which these events take place by the owners and/or representatives thereof, I hereby, for myself, my heirs, personal representatives and assigns, release, discharge and agree to hold blameless and indemnify SHS, LLC, it’s owners and agents, employees, and/or members of all of them and from any liability loss, claims, demands and possible causes of action that might otherwise accrue from a loss, damage or injury (including death) to my person or property, in any way resulting from or arising in connection with or related to, any event, and whether arising, while engaged in competition or in practice or preparation thereof, while upon, entering or departing from said track facilities and/or premises, from any cause whatsoever, including, without limitation, the failure of anyone to enforce rules and regulations, failure to make inspections, or the negligence of other persons.
I understand that racing in motorsports competition can constitute a hazardous activity and that by reason of my application for a SHS, LLC membership and/or my participation in or presence at any competition event, I am assuming all hazards and risks related thereto.
I agree that the SHS, LLC may use my name and/or picture, including videos/pictures of my racing equipment and video/pictures taken at any event, for any purpose by SHS, LLC and said granted entities. Any permission granted to the photographer by SHS, LLC shall extend to his/her successors, legal representatives, licensees and assigns and shall be irrevocable and perpetual without any further or additional claim for compensation by myself; hereinto use of the work shall be unrestricted as to location, quantity or frequency, may be for any purpose and in any medium whatsoever, whether foreseen or unforeseen at this time, except where such use is in contravention of the law; therefore permission is specifically granted for the work to be edited, altered, distorted, used in whole or in part, in conjunction with other images, graphics, text and sound in any way whatsoever and without restrictions; thereof permission herein granted is absolute and final and shall not be subject to further inspection or approval by myself at any stage in the use of the said work; use of the work may be in conjunction with my own or fictitious names; photographer shall own all rights in the work which shall accrue to the benefit of his/her successors, legal representatives and assign.
I agree to abide by the SHS, LLC competition rules and to respect the authority of the race officials and personnel at all events. I have read this application in its entirety and stipulate, under penalty of perjury, that all statistical information set forth herein by me is true and complete. I have thoroughly read and understand the SHS, LLC guidelines, rules and demands and I agree with the rules set forth by the current Operators.
BY SUBMITTING THIS APPLICATION, I AGREE TO ALL OF THE TERMS & CONDITIONS SET FORTH ABOVE.
